Rail Freight Antitrust Litigation
Working as a member of an Executive Committee of plaintiffs' law firms, Gold Bennett Cera & Sidener LLP represents companies that paid anti-competitively set fuel surcharges for the unregulated shipment of freight by rail from the country's largest railroads during the period July 1, 2003, through December 31, 2008 ("Class Period"). This antitrust Sherman Act Section One class action case, which is pending in U.S. District Court for the District of Columbia, alleges that shippers who purchased unregulated rail freight transportation services from the defendant railroads paid fuel surcharges that were set not by competitive market forces, but rather by coordination among the defendant railroads.
Air Cargo Antitrust Litigation
Gold Bennett Cera & Sidener LLP is representing a Class Representative of a class of direct purchasers of air cargo shipping services providers in an antitrust class action against the world's major providers of air cargo shipping services. This case is currently pending in the United States District Court for the Eastern District of New York and alleges that during the time period January 1, 2000 through at least February 14, 2006, the defendants participated in a conspiracy to impose inflated surcharges (such as fuel surcharges) on its customers, jointly agreeing to eliminate or prevent discounting of air cargo services, agreeing on yields, and allocating customers, routes, or territories all in violation of the Section One of the Sherman Antitrust Act.
Eggs Antitrust Litigation
Gold Bennett Cera & Sidener LLP represents Representatives of a Class of direct purchasers of shell eggs and processed egg products who allege that, from January 1, 2000 to the present, a cartel of egg producers, through the auspices of their trade groups, engaged in an unlawful scheme to artificially inflate egg prices by restricting the supply of both laying hens and eggs across the country.
EPDM Antitrust Litigation
Gold Bennett Cera & Sidener LLP is Co-Lead Counsel in an antitrust class action involving ethylene propylene diene monomer synthetic rubber ("EPDM"). Settlements totaling $106 million have been obtained. The complaint alleges that the defendants conspired to fix, raise, maintain and/or stabilize prices for EPDM sold in the United States and elsewhere. The class action, which has been coordinated for pretrial proceedings in the District of Connecticut, is on behalf of those who directly purchased EPDM from defendants between January 1, 1994 and December 12, 2002.
